Terms and Conditions

These Terms & Conditions apply to services provided by Forward Impact, operated by Bronte May Phillips, ABN 54 479 044 349.

By engaging Forward Impact, you agree to these Terms & Conditions.

1. Services

Forward Impact provides funding, strategy, project development and related consulting services to organisations and individuals.

The specific services, deliverables, timeframe and price will be discussed and agreed with the client before work commences.

Services may include (not limited to):

Funding Strategy
Project & Grant Development
Ongoing Funding Research & Support
Stakeholder & Partnership Support
Strategic Communications

2. Initial consultation and selecting the right service

An initial conversation may be used to understand your organisation, project, goals and funding needs.

Following this discussion, Forward Impact will recommend the service or approach that best suits your needs.

No paid work will commence until the service, scope, price and expected deliverables have been agreed.

3. Quotes and pricing

Prices displayed on the Forward Impact website are indicative starting prices only unless expressly stated otherwise.

The final price will depend on the scope, complexity and requirements of the work.

A quote or written confirmation of the agreed service will be provided before work commences.

Any additional work outside the agreed scope will be discussed with you and agreed before the additional work is undertaken.

4. Payment

Once the appropriate service has been agreed following the initial consultation or discussion, Forward Impact will issue an invoice.

100% payment is required before work commences, unless an alternative payment arrangement has been agreed in writing.

Payment is by bank transfer unless otherwise agreed.

Work will generally commence once payment has been received.

5. Client responsibilities

To provide the services effectively, Forward Impact may require information, documents, approvals or feedback from you.

You are responsible for providing information that is accurate, complete and reasonably required for the agreed work.

Delays in providing information, approvals or feedback may affect the timeframe for completing the service.

6. Funding outcomes

Forward Impact provides advice, strategy and support designed to improve the quality and funding readiness of a project.

However, Forward Impact does not guarantee funding, grant approval or any particular outcome.

Funding decisions are made by the relevant funding body and are outside Forward Impact's control.

7. Client cancellation

If you need to cancel a service before work has commenced, please contact Forward Impact as soon as possible.

Where payment has already been made and work has not commenced, Forward Impact will generally provide a refund, less any reasonable costs already incurred specifically for the engagement, subject to any rights you may have under the Australian Consumer Law.

If work has commenced, any refund will take into account the work already completed, time spent and reasonable costs incurred.

Where appropriate, Forward Impact may offer to reschedule the service instead of providing a refund.

Nothing in this section limits or excludes any rights or remedies available to you under the Australian Consumer Law.

8. Cancellation or inability to provide services

If Forward Impact needs to cancel a service or is unable to provide the agreed service, I will contact you as soon as reasonably possible to discuss rescheduling, an alternative arrangement or an appropriate refund.

Where services have not been provided, any prepaid amount relating to those services will be refunded, subject to any lawful deductions for services already provided or costs properly incurred.

9. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

to cancel your service contract with us; and
to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified within a reasonable time and, if this is not done, to cancel the service contract and obtain a refund for the unused portion.

Nothing in these Terms is intended to exclude, restrict or modify rights that cannot legally be excluded under the Australian Consumer Law.

10. Confidentiality

Forward Impact will treat information provided by clients as confidential and will not intentionally disclose confidential information to third parties except:

with the client's permission;
where necessary to provide an agreed service;
where required by law; or
where the information is already publicly available.

Clients should avoid providing unnecessary personal, sensitive or confidential information through the website contact form.

11. Intellectual property

Unless otherwise agreed in writing, materials created specifically for a client as part of a paid service may be used by that client for its intended business or project purposes once payment has been received in full.

Forward Impact retains ownership of its pre-existing templates, processes, systems, methodologies, know-how and other materials developed independently of the client's engagement.

Clients must not reproduce, resell or commercially distribute Forward Impact's proprietary templates or resources without permission.

12. Information provided by clients

Forward Impact may rely on information provided by the client when preparing advice, project materials or funding applications.

Forward Impact is not responsible for inaccuracies, omissions or misleading information supplied by the client.

Clients remain responsible for reviewing and approving information submitted to funding bodies or other third parties on their behalf.

13. No guarantee of funding or success

Forward Impact does not guarantee that:

a client will receive funding;
an application will be successful;
a funding opportunity will remain available;
a funding body will accept a particular interpretation of its guidelines; or
a particular project outcome will be achieved.

Funding decisions are made by independent funding bodies.

14. Limitation of liability

To the extent permitted by law, Forward Impact is not responsible for losses arising from matters outside its reasonable control, including funding decisions, changes to funding programs, changes to eligibility requirements, delays caused by third parties or information supplied incorrectly by the client.

Nothing in these Terms excludes liability that cannot legally be excluded under Australian law.

15. Changes to these Terms

Forward Impact may update these Terms from time to time.

The Terms that apply to a particular engagement will be those provided or agreed with the client when the service is confirmed.

16. Governing law

These Terms are governed by the laws of Queensland, Australia.
